XCG recently assisted 1500985 Ontario Limited in obtaining a Record of Site Condition (RSC) within the City of Kitchener for purposes of the redevelopment of a commercial building in the Downtown core. Since the late 1800’s the property has been used for predominantly commercial purposes. The City of Kitchener requested that 1500985 Ontario Limited obtain an RSC as a requirement for a building permit to convert a portion of the Property from commercial to residential use.
XCG conducted a Phase One ESA to the O. Reg. 153/04 standards beginning in September 2014 culminating with the successful filing of the RSC in August 2015. During the RSC review process, the MOECC highlighted concerns for potentially contaminating activities (PCAs) from properties adjacent to and in the area of the subject property which suggested a Phase Two ESA (Intrusive investigation) was warranted.

XCG successfully defended the filing for the RSC based on the Phase One ESA alone by detailing the insignificance of these PCAs based on the historical information obtained and reviewed, as well as the presumed flow of groundwater in the area which illustrated that the subject property was not directly downgradient of the PCAs.
Subsequently, the MOECC agreed with XCG’s findings and acknowledged the filing of the RSC based on the Phase One ESA alone. This enabled 1500985 Ontario Limited to obtain their building permit from the City and in the process saved the client thousands of dollars in Phase Two ESA costs.
