DUE DILIGENCE TO OBTAIN RECORD OF SITE CONDITION IN LONDON, ONTARIO
In July 2016, XCG was retained by The Tricar Group to conduct due diligence activities to support the purchase of the commercial properties identified as 32, 36, and 40 York Street in London, Ontario (subject site) and future submission of a Record of Site Condition (RSC).
A Phase I Environmental Site Assessment (ESA) was completed that identified the historic operation of a dry-cleaning facility in the east portion of the subject site. Between July and August 2016, a Phase II ESA was conducted to investigate the soil and groundwater quality at the subject site through advancement of nine boreholes, instrumentation of one borehole as a groundwater monitoring well, and sampling of three existing and one newly installed monitoring well. Based on review of analytical results, soil impacts related to the dry-cleaning operations were identified in the northeast portion of the subject site and soil impacts related to poor fill quality were identified in the southwest portion of the subject site in the vicinity of a previously developed parking area. No dry-cleaning related impacts were identified in the groundwater samples collected from the on-site monitoring wells. Based on the results of the due diligence Phase I and Phase II ESAs, Tricar proceeded with the purchase of the subject site.
In September 2017, Tricar subsequently requested that XCG prepare the necessary documentation to support the filing of a RSC for the subject site to facilitate the redevelopment for mixed commercial/residential use. As such, XCG updated the due diligence documents to reflect the more stringent reporting requirements for both the Phase One and Phase Two Environmental Site Assessments. Based on the presence of soil impacts in the two portions of the subject site, XCG assisted with the direction of remedial excavations and collected confirmatory soil samples to document the remaining in-situ soil quality. Based on the results of the confirmatory soil samples, XCG finalized the Phase One and Phase Two ESA reports and submitted the necessary documentation to the Ministry of the Environment and Climate Change (MOECC) in November 2017 to obtain a RSC for the subject site.
XCG received comments from the MOECC in December 2017 requesting additional groundwater analytical data to support the RSC submission. As such, in January 2018 XCG conducted additional investigative work included installation of two additional groundwater monitoring well and collection of groundwater samples for additional chemical analysis. The documentation for the RSC submission was updated to reflect the additional groundwater analytical results and re-submitted for acknowledgement by the MOECC. The RSC was acknowledged in 2018.
